Soldier avoids OTH discharge

A Fort Campbell Soldier avoided separation from the Army with an Other Than Honorable (OTH) discharge following separation board proceedings on December 7, 2010. The Government's recorder (trial counsel) argued that the Soldier should be separated from the Army with an Other Than Honorable Discharge based on three allegations of the commission of a serious offense. The Separation Board heard the testimony of 9 witnesses, including the Soldier's own testimony. Attorney R. Lance Miller argued that the Soldier, who had served on three separate overseas deployments, should be retained. The Board determined that the Soldier should be separated under a General Discharge, be recommended to the convening authority that the separation should suspended for a period of twelve months. In the event the Soldier faces no further problems, the discharge would then be set aside. "We are very pleased with the favorable result and the chance our Soldier has to redeem himself and continue to serve", Miller said.
