The largest sex-trafficking case in US history began in federal court in Nashville on 3/20/2012.  Originally, 30 defendants were so charged.  15 of the defendants were severed out ot the trial.  Three of the remaining 15 were also severed from the trial owing to their age.  Two entered guilty pleas.  Of the remaining nine defendants, nine went to trial in US federal court in the Middle District of Tennessee (federal court).  Mr. Miller's client, Mohammed Ahmed Amalle, was found NOT GUILTY of all charges and specifications on the indictment following a lengthy seven week trial.  The evidence was simply insufficient to support any conviction for these charges and Mr. Amalle is now free to pursue his livliehood and freedom and peace in Minneapolis as the Constitution intended.

Lance Miller's representation of Jason Lee White changed the law on kidnapping.  Following a Jury trial, defendant Jason Lee White was convicted of Aggravated Robbery and Especially Aggravated Kidnapping of the store manager at the White Castle on Wilma Rudolph Boulevard in Clarksville, TN.  Miller appealed the conviction of Kidnapping based on previous TN Supreme Court rulings.  The Tennessee Court of Appeals agreed and reversed and dismissed the conviction of kidnapping, based upon their finding that the removal or confinement was necessary or incidient to the underlying felony.  The TN Supreme Court agreed.  They reversed and remanded the conviction with special jury instructions to that effect.  It was a huge win for justice and the Tennessee Constitution!

On April 17, all of the major news services in Nashville reported the arrest of Adam Chaffin on charges of Aggravated Robbery, Especially Aggravated Kidnapping and Criminal Impersonation.

On April 15, 2011, federal law enforcement authorities arrested more than two dozen defendants in a massive bust. Details of the arrest were published on the Nashville news.

Attorney Lance Miller was appointed to represent one of these defendants. The United States Attorney moved to have this defendant detained until his trial, which has not yet been scheduled. The detention hearing for April 20, 2011 in federal Court in Nashville. Fortunately, the Judge ordered the release of Attorney Miller's client until he is brought to trial. The family of the Defendant was immensely relieved at news of his release pending trial.

Attorney Lance Miller argued a criminal appeal before the Tennessee Supreme Court. Lance Miller represents Jason Lee White, who was convicted at a jury trial of Robbery, burglary, and especially aggravated kidnapping. Lance Miller appealed the conviction of especially aggravated kidnapping, which was over half Mr. White's sentence. The Court of Criminal Appeals reversed and dismissed that conviction, applying the applicable case law. The State then appealed the Court of Appeals decision. Argument before the Supreme Court went well - Attorney Miller and his client are cautiously optimistic that the decision of the Court of Appeals will be affirmed by the Supreme Court.

Lance Miller appointed to CJA Panel Posted By Attorney Lance Miller on Jan 25, 2011 6:45am PST On Monday, January 24, 2011, Attorney Lance Miller was notified that he was accepted onto the Criminal Justice Act panel with the Federal Public Defender's Office for the Middle District of Tennessee in Nashville. The CJA panel is a pool of attorneys who represent defendants charged with crimes in federal court in Nashville. The process is a rather lengthy one that involves training, serving as "second chair" on other federal cases, and an interview process with the Federal Defender personally. Presently, there are only two other attorneys in Clarksville who are on the CJA panel. We are very pleased with the appointment and look forward to this expansion of our practice.

Lance Miller will be before the Tennessee Supreme Court on February 2, 2011. The case is State v. Jason Lee White. Mr. White was previously convicted of aggravated burglary, aggravated robbery, and especially aggravated kidnapping. Lance Miller filed a motion to set aside the conviction for especially aggravated kidnapping, which was denied by the trial court. Mr. Miller appealed this ruling, arguing that Mr. White's right to due process of law was denied with convictions of both aggravated robbery and kidnapping where the acts involved in the kidnapping were essentially incidental to the robbery. The case was heard before the Court of Criminal Appeals in February, 2010. In May, 2010, the appellate court agreed with Mr. Miller. They reversed and dismissed Mr. White's conviction for especially aggravated kidnapping, which effectively reduced Mr. White's sentence by 25 years. The State appealed to the Tennessee Supreme Court. Both sides have submitted their briefs to the Supreme Court. The case is set for argument on February 2, 2011. We believe that the Court of Criminal Appeals' decision was consistent with previous caselaw and will vigorously argue that the Tennessee Supreme Court should affirm the Court of Appeals' ruling.

Soldier avoids OTH discharge Posted By Attorney Lance Miller on Dec 8, 2010 6:27am PST A Fort Campbell Soldier avoided separation from the Army with an Other Than Honorable (OTH) discharge following separation board proceedings on December 7, 2010. The Government's recorder (trial counsel) argued that the Soldier should be separated from the Army with an Other Than Honorable Discharge based on three allegations of the commission of a serious offense. The Separation Board heard the testimony of 9 witnesses, including the Soldier's own testimony. Attorney R. Lance Miller argued that the Soldier, who had served on three separate overseas deployments, should be retained. The Board determined that the Soldier should be separated under a General Discharge, be recommended to the convening authority that the separation should suspended for a period of twelve months. In the event the Soldier faces no further problems, the discharge would then be set aside. "We are very pleased with the favorable result and the chance our Soldier has to redeem himself and continue to serve", Miller said.

Soldier cleared of DUI Charge Posted By Attorney Lance Miller on Dec 2, 2010 1:05pm PST A Fort Campbell soldier was cleared of DUI charges in the federal district court for the Western District of Kentucky. Attorney Lance Miller appeared representing the soldier at his first appearance, also referred to as "arraignment". Following a consultation between the Special Assistant U.S. Attorney and Attorney Miller, the Government decided to dismiss all charges against the Soldier. We were very pleased at such a quick and favorable outcome for our client.

Staff Sergeant avoids Rape Charges Posted By Attorney Lance Miller on Dec 1, 2010 1:59pm PST A Fort Campbell Staff Sergeant will not be charged with rape following an extensive investigation by CID. Attorney Lance Miller has been representing the Staff Sergeant over the past several months. The ongoing interaction between Mr. Miller, CID agents, and the Office of the Staff Judge Advocate culminated in a decision that charges would not be preferred against the Staff Sergeant.
