Facing DUI Charges in Clarksville?

Just as in every other part of America the act of driving under the influence in Tennessee is a crime. While most offenses will be treated as misdemeanors this does not mean that the penalties upon conviction will be slight or inconsequential. Should repeat offenses of DUI be the case then the classification can be extended to make this act a felony.

The key elements in proving such a case are:

  • The individual must have been under the influence of drugs or alcohol. The BAC or  Blood Alcohol Content must be at the level of .08% or higher
  • The individual had to be operating or in control of a vehicle which was on a road, highway, alley or any location that the public would frequent
  • The fact of the BAC being at .08% or higher is enough to establish a DUI charge. Whether or not the individual demonstrated any driving impairment would be irrelevant.
  • Even if the drug was prescribed by a doctor the individual can still be charged with operating a vehicle under the influence of a narcotic.

Fighting such charges requires the skill of an experienced Clarksville criminal defense lawyer. There are a number of possible defenses and much can depend upon how well the lawyer knows the intimate details of DUI related police procedures. It is not unheard of that the evidence obtained is suspect and can result in a case being dismissed due to faulty facts. With years of effective courtroom experience Mr. Lance Miller fully understands how to build a defense for this type of charge.

Penalties for DUI Convictions

Tennessee law provides for stiff penalties even upon the first time offense. If convicted of a DUI then the first-timer can face a maximum sentence of almost one year. The minimum sentence will be 48 hours in jail, a $350 fine plus court costs, mandatory DUI education and the loss of your driver's license and privileges. As a note, if the BAC was at .20% or higher a minimum jail sentence of one week will be administered.

Repeat offenders suffer even stiffer penalties. If this is your second conviction you could forfeit your vehicle. If this is your fourth or higher offense you could be facing felony charges and very serious penalties.
